Welcome to Gatepass®, a product of Moran Group designed to make land and homeownership accessible and affordable for all. By using our website, mobile application, or engaging in any transaction with Gatepass®, you agree to the following Terms & Conditions.
Please read them carefully.
1. Definitions

Gatepass®: The platform operated by Moran Group to provide land and housing financing solutions.

User or Customer: Any person interacting with the Gatepass® platform or purchasing land/housing products.

Plot: A parcel of land sold under Gatepass® projects.

Pass: A payment tier (Fidelity, Premium, Platinum) defining eligibility for a future home.

Home Construction Phase: The stage following full land payment, where Gatepass® builds a house for eligible customers.
2. Eligibility
To engage in any purchase or agreement with Gatepass®, you must:

Be 18 years or older

Provide valid identification (Kenyan National ID or Passport)

Agree to comply with these Terms & Conditions
Gatepass® reserves the right to decline applications based on due diligence findings.
3. Land Purchase Terms

Land is sold under flexible payment plans, ranging from KES 20,000 – KES 100,000/month, depending on the chosen Pass.
-
Customers must pay consistently for a minimum of 36 months (3 years) to qualify for the next phase.
-
A title deed is issued only upon full payment of the land cost.
-
Gatepass® guarantees all plots are genuine, with clean titles verified before sale.
4. Home Construction Eligibility
Customers may qualify for Gatepass® to build them a home if:

They complete 36 consecutive months of plot payments without default.

They meet the minimum contribution aligned with their chosen Pass:

Fidelity Pass: KES 3.5 Million – 5 Million Home
-
Premium Pass: KES 5 Million – 7 Million Home
-
Platinum Pass: KES 7 Million – 10 Million Home
-
5. Home Financing Terms
-
Once home construction begins, customers repay the building cost over 10 years.
-
The interest rate for home repayment is fixed at 6.99% per annum.

Gatepass® may require an updated agreement for this phase, outlining construction details, timelines, and repayment structure.
6. Payment & Default Policy
-
Payments must be made on time every month via approved payment methods (e.g., MPESA, bank transfer).
-
A grace period of 10 days is allowed for late payments, after which penalties may apply.

Gatepass® reserves the right to suspend or cancel agreements if a customer defaults for more than 60 consecutive days.
7. No Credit Checks
Gatepass® does not require credit scores or income verification. Instead, we evaluate trust and consistency through your monthly payment record.
8. Refunds & Cancellations

Deposits are non-refundable after 14 days unless otherwise stated in writing.

Refunds (where applicable) are subject to deductions for administrative costs.

If a customer cancels the plan after multiple months of payment, partial refunds may be considered on a case-by-case basis.
9. Use of the Website & Platform
By using our digital platforms (website, app, SMS systems), you agree:

Not to misuse the platform or attempt to breach security

Not to submit false documents or impersonate others

To provide accurate and truthful information during registration and application

To be contacted via SMS, email, or WhatsApp regarding your account
10. Intellectual Property
All logos, designs, text, and images on the Gatepass® platform are the property of Moran Group and may not be reproduced or used without written permission.
11. Liability & Disclaimer
Gatepass® and its partners will not be held liable for:

Delays caused by third-party service providers (lawyers, valuers, surveyors)

Delays caused by force majeure events (e.g., natural disasters, government actions)
-
Client misuse of the platform or dishonesty during the process
We strive to deliver accurate information, but pricing, availability, and timelines may change.
12. Dispute Resolution
Any disputes arising from this agreement shall be:

Resolved first through negotiation and mediation

If unresolved, submitted to arbitration under the Arbitration Act (Kenya)

All disputes shall be governed by Kenyan law
13. Amendments
Gatepass® may update these Terms & Conditions at any time. Users will be notified of significant changes through email or posted notices.
